This announcement marks a new democratic phase for Algeria, enabling citizens to exercise their sovereignty and select representatives for the municipal and provincial popular assemblies. The move is positioned within the framework of constitutional and legal provisions that regulate the electoral process, outlining its various stages and conditions.

Constitutional expert Moussa Boudhan affirmed that these local elections represent another democratic milestone for Algeria, providing an opportunity for citizens to engage in popular sovereignty, in accordance with articles 7, 8, 9, 12, and other provisions of the November 2020 Constitution. Boudhan emphasized the critical importance of these elections for managing local public affairs. He also highlighted that the democratic state, as defined by the constitutional system, is solidified through free, periodic, and fair elections, particularly those for local councils that represent the aspirations and concerns of the people. Both the Municipal Popular Assembly and the Provincial Popular Assembly are recognized as constitutional institutions by articles 16, 17, 18, and 19 of the Constitution, with Article 91 granting the President the authority to convoke the electorate via a presidential decree.

The organization of these local elections extends beyond constitutional provisions, guided by a comprehensive set of legal and institutional mechanisms. Key among these is the Amended and Supplemented Order No. 21-01, which outlines the Organic Law on the Electoral System, including articles 62, 64, 65, and 91, as well as articles 169 to 190. Article 62 mandates the regular review of electoral rolls during the last quarter of each year, with additional revisions possible through the presidential decree convoking the electorate. Furthermore, the conditions for candidacy for membership in municipal and provincial popular assemblies, while differing slightly from those for the National Popular Assembly, share fundamental requirements related to integrity, ethics, and public life, as stipulated in articles 169 and 184 of the Organic Law. These provisions aim to ensure that only eligible individuals, untainted by corruption, are elected to public office, thereby safeguarding the integrity of political and public life.

President Abdelmadjid Tebboune has officially convoked the electorate for local elections scheduled for November 28, marking a significant democratic step.
