New Customs Rule Regularizes Vehicle Import Age Overruns

The 2027 Finance Law (PLF 2027) includes a new article that permits the customs clearance of new or used vehicles that have exceeded the regulatory age limit by a maximum of six months. This provision applies to both future import operations and vehicles already introduced into Algerian territory before the law's publication. The regulation stipulates that the age condition must have been met at the time of direct shipment to the customs territory, with a three percent surcharge on applicable duties and taxes for each month or fraction of a month of exceeding the age limit.

The government's explanation for this measure highlights its objective to regularize undeclared imported vehicles, both new and used, that have been unable to clear customs due to exceeding the age condition. These delays often result from factors beyond the importer's control, such as international shipping times, logistical challenges, transit issues, or foreign port formalities. Such circumstances can cause vehicles, which met the age requirement at the date of shipment, to exceed it by the time customs declarations are made, leading to vehicles being blocked in customs zones and incurring additional financial burdens like storage and demurrage costs.

This new legislative measure is anticipated to yield multiple positive outcomes. It aims to clear the existing stock of vehicles currently held in customs zones, decongest port areas, and reduce the financial costs associated with prolonged vehicle immobilization. Furthermore, it seeks to legally secure ongoing and completed import operations. The initiative also presents a dual benefit of generating additional tax revenue for the state through the instituted surcharge, which serves as both compensation for the allowed overrun and a deterrent against excessive delays, while preserving the public policy objective of the established age condition by strictly limiting the tolerance to six months and requiring adherence to the age limit at the date of shipment.
