Finance Bill 2027 Proposes Capital Regularization

The Project Law of Finance (PLF) 2027 outlines an exceptional voluntary regularization scheme for undeclared capital in Algeria. This initiative targets physical persons residing in Algeria who hold sums not declared to the tax administration. Under the proposed provisions, individuals opting into the scheme will have the declared amounts subjected to a unique, dischargeable tax rate of 12%.

A key aspect of this framework is the absence of fiscal sanctions or criminal prosecutions for the regularized sums, with the exception of those linked to criminally reprehensible activities such as terrorism financing or corruption. The government's objective, as explained in the statement of reasons, is to foster voluntary tax compliance and provide a unique opportunity for individuals to formalize capital currently outside the official economic circuit. The deadline for subscribing to this scheme is set for December 31, 2027.

The regularization process involves submitting a simplified declaration, using a form provided by the tax administration, to the fiscal service of the subscriber's habitual residence. This mechanism is designed to be both incentive-based and simplified, aiming to reintegrate informal financial resources into the official economy. By implementing this measure, the state seeks to strengthen the resources of the public treasury, while the 12% unique tax definitively discharges taxpayers from any further fiscal obligations related to the regularized amounts.
