Civil Code Mandates Written Leases for Algerian Housing

The Algerian Civil Code has mandated written leases for housing rentals since 2007, a reform aimed at enhancing transparency and clarifying the rights and obligations of both tenants and landlords. This legal requirement dictates that oral agreements hold no legal value, ensuring that all rental contracts are formal and possess a certain date. To further solidify this framework, the registration of habitation leases and sub-leases is compulsory within one month of their signing, incurring a fixed fee of 1,500 DA. This measure provides an incontestable date for contracts, making them enforceable against third parties.

Under this codified system, landlords are obligated to provide a habitable property and undertake all necessary maintenance and repairs, excluding tenant-specific upkeep. Furthermore, owners of properties constructed in Algeria are legally required to secure natural disaster insurance as per a 2003 ordinance. Tenants, in turn, are bound to pay rent by agreed deadlines and are prohibited from altering the property, sub-leasing, or assigning their lease without explicit written consent from the landlord. The law also enables tenants to terminate leases early for professional or family reasons, provided they give two months' notice through an extrajudicial act.

The legal framework also details financial obligations, including the Global Income Tax (IRG) on rental income, which stands at 7% for residential properties. Importantly, since 2022, loans for use concluded between first-degree ascendants and descendants are exempt from this property income tax. Emphasizing clear communication and documentation, the law promotes amicable resolution for disagreements. Written contracts, detailed property inventories at entry and exit, and rent receipts are foundational for discussions and, if necessary, for legal recourse in a competent court. This comprehensive approach ensures a structured and legally sound environment for housing rentals across Algeria.
