Algiers, January 5, 2026 – The Ministry of National Education has issued a statement regarding the regularization of the legal status of members of trade union organizations. Minister of National Education, Mohamed Seghir Saadaoui, affirmed that the process of addressing and settling the legal standing of union members is being conducted in full collaboration and agreement with social partners, adhering to the provisions of Law No. 23-02, particularly Articles 104 to 107 and Article 119.
During a video conference held yesterday evening with the Directors of Education for the wilayas (provinces) at the ministry headquarters in El Mouradia, the Minister clarified that the handling of the legal status of union members is also in accordance with Executive Decree No. 23-360, which pertains to the modalities of secondment for exercising the duties of a permanent representative at the level of trade union organizations.
The Minister emphasized the Ministry’s commitment to ensuring that this regularization process safeguards the rights of all employees, underscoring that the right to unionize is constitutionally guaranteed. The objective of these measures is to rectify the legal and administrative situations of union members and ensure their alignment with regulatory texts.
Furthermore, the Minister instructed the Directors of Education to ensure the implementation of the installation of those concerned in their positions in an atmosphere of respect, objectivity, and efficiency. They were directed to limit their actions to recording administrative statuses (attendance or absence) without taking any further measures until the central-level study of files submitted by trade union organizations is completed and the final lists of seconded individuals are announced in accordance with the law.
The Ministry reiterated its dedication to upholding labor rights and ensuring a fair and transparent process for all stakeholders involved.
