New Rules Require Permission for Public Sector Job Competitions

Algiers – Public sector employees in Algeria will now require explicit permission from their superiors to participate in recruitment competitions for new positions. This directive, issued by the General Directorate of Public Service, aims to streamline the process and ensure minimal disruption to public services.

The new regulation mandates that administrative bodies grant employees permission to compete for positions that align with their qualifications and acquired certifications. However, exceptions will be made only in cases where professional necessities prevent such authorization.

The move is intended to bolster the value of professional certifications held by public sector workers and improve their career prospects within government institutions. Authorities hope that this will ultimately contribute to enhanced performance and productivity across the public sector, while also upholding the principle of equal opportunity in public service employment.

This clarification came in response to a written inquiry (number 9170) addressed to the Prime Minister concerning the recognition of professional certifications obtained by employees after their initial hiring. The Directorate confirmed that it has communicated the relevant guidelines to the concerned parties.

The Directorate emphasized that recruitment within public institutions adheres to the principle of equal access to public sector jobs, as enshrined in Article 74 of Order No. 06-03, dated July 15, 2006, which outlines the general statutes for public service. This principle, as defined in Article 80 of the same order, is implemented through competitive examinations based on tests, qualifications, or professional assessments.

The Directorate further stressed the importance of fulfilling all legal requirements for public sector employment, including possessing the necessary qualifications or certifications, as stipulated in Article 75 of Order No. 06-03. Referring to Circular No. 03, dated January 14, 2001, the Directorate highlighted the possibility for employees to participate in recruitment competitions organized by public institutions, including their own, to improve their professional standing and attain positions commensurate with their academic qualifications, thus contributing to the overall improvement of public administration.

The directive reinforces the obligation of administrative bodies to grant employees permission to participate in competitions for positions that correspond to their qualifications, with exceptions limited to instances of critical professional need. This new measure is expected to have a significant impact on career advancement opportunities within the Algerian public sector.
