Clarifications Regarding the Draft Traffic Law

Minister of Justice and Keeper of the Seals, Lotfi Boudjemaa, has provided clarifications regarding the draft traffic law, specifically concerning penal provisions and increased penalties. During his presentation of an organic law text on the basic statute of the judiciary at the Council of the Nation on Tuesday, Boudjemaa noted that “some have not fully understood the content of this text, particularly regarding the penal provisions.”

The Minister emphasized that “these penalties do not apply to individuals involved in ordinary traffic accidents. Instead, the increased severity is linked to specific circumstances, such as driving under the influence of alcohol or driving while consuming psychotropic substances or drugs.”

He added: “If the accident does not result in a fatality, the penalty differs from an accident that leads to death, in which case the penalty is toughened.”

The Minister reassured that the law serves the interests of citizens, stating: “Any legislation enacted in any country is based on the study of specific developments.”

He continued: “Whenever we address the security, lives, and property of citizens, we need to reorganize, regulate, and perhaps toughen certain provisions to primarily ensure their protection; this is the core principle.”
