Council of the Nation: Reservations Expressed on 11 Articles of the Traffic Law

Members of the Council of the Nation have expressed reservations regarding 11 articles of the draft traffic law concerning custodial penalties in cases of involuntary manslaughter that carry a criminal nature.

The reservations on these 11 articles follow objections raised regarding the tightening of penalties and the increase in fines within the legal text. The articles subject to reservations are 104, 119, 121, 124, 125, 127, 128, 129, 161, 166, and 170.

Members of the Council of the Nation voted on 179 articles while withholding the vote on the 11 specific articles. These will now be subject to legal and constitutional procedures by being referred to a joint committee composed of equal members from the People’s National Assembly and the Council of the Nation.

This procedure is based on the provisions of Article 145 of the Constitution, as well as Chapter Three of Organic Law No. 16-12, which pertains to the organization and functioning of the People’s National Assembly and the Council of the Nation.

The reserved articles will be reviewed to allow for the removal of the criminal character from the text of the law.
