Council of the Nation: Reservations on 13 Articles in the Law Criminalizing Colonialism

Members of the Council of the Nation approved on Thursday a draft law concerning the criminalization of French colonialism in Algeria, while expressing reservations on 13 articles. These articles will be submitted to a joint committee comprising representatives from the People’s National Assembly and the Council of the Nation, within the framework of constitutional mechanisms used to resolve disputed provisions.

The preliminary report on the proposed law praised the overall provisions of the text but recorded explicit reservations regarding several articles, particularly those related to the issues of compensation and apologies.

The National Defense Committee justified its stance by citing a lack of harmony between the aforementioned articles and the national policy established by President Abdelmadjid Tebboune. This policy is based on demanding the recognition of colonial crimes without seeking compensation or apologies.

The committee emphasized the necessity of achieving consistency between the sovereign political position and the organizing legislative framework. It stressed that certain provisions of the text require adjustments in both phrasing and content, necessitating improvements and corrections to enhance the quality of the legislation and ensure the text’s coherence, accuracy, and legal and institutional effectiveness.
