Executive decree specifies conditions for retirement before the legal age for national education employees

Executive Decree No. 26-74, dated 25 Rajab 1447, corresponding to January 14, 2026, was published in the sixth issue of the Official Gazette. This decree specifies the conditions and procedures for employees in certain specialized national education sectors to benefit from a retirement pension before reaching the legal age.

According to the text of the decree, employees belonging to specialized education sectors—including teachers, professors, supervisors, directors of educational institutions, and inspectors—are granted the right to request retirement starting at age 57 for men and age 52 for women.

The employee must meet the legal requirements for a retirement pension and be in active service at the time of submitting the retirement request. Employees wishing to benefit from the pension at the specified age must submit a dated and signed request to their workplace during the first three months of the school year.

The decree explicitly states that the employing authority cannot refuse the employee’s retirement request, and the request must be kept in their administrative file. Furthermore, pensions that have been settled are non-reversible if the employee resumes paid activity after retirement.

This decree comes within the context of organizing the professional careers of national education sector employees, taking into account the specific nature of educational roles and providing the possibility of early retirement within a clear and defined legal framework.
