Regularization of the status of trade union members: Ministry of Education issues an important statement

The Minister of National Education, Mohamed Seghir Saadaoui, confirmed that the processing and regularization of the legal status of trade union members are being carried out in a participatory and consensual manner with social partners, within the framework of Law No. 23-02, specifically Articles 104 to 107 and Article 119.

During a video conference with provincial education directors held yesterday evening at the ministry’s headquarters in El Mouradia, the Minister explained that the legal status of trade union members is also being addressed in accordance with Executive Decree No. 23-360, which concerns the procedures for secondment to perform permanent duties within trade union organizations.

The Minister also noted that the ministry is keen to ensure this regularization protects the rights of all employees, emphasizing that trade union rights are constitutionally guaranteed. He stated that the objective of these measures is to correct the legal and administrative statuses of trade union members and ensure their consistency with regulatory texts.

Furthermore, the Minister instructed education directors to implement the installation of the concerned individuals in their positions in an atmosphere of respect, objectivity, and effectiveness. He directed them to limit actions to recording administrative statuses (attendance or absence) without taking any further measures until the review of files submitted by trade union organizations at the central level is completed and the final lists of secondees are announced as permitted by law.
