Prime Minister Oversees Seminar on Technical Constitutional Amendment and Election Law Projects

Prime Minister Saifi Gharib oversaw a seminar today, Saturday, at the Palace of Nations, regarding the draft technical amendment to the Constitution and the organic law related to elections.

The seminar was attended by the Chief of Staff of the Presidency, Boualem Boualem, members of the government, leaders of political parties, and the acting head of the National Independent Authority for Elections.

The Chief of Staff of the Presidency presented a report containing 10 proposals for the technical amendment of the Constitution.

The first proposal emphasizes the necessity of including a requirement to prove an educational level for candidates running for the office of President of the Republic.

The second proposal involves regulating the constitutional swearing-in ceremony by suggesting optimal organizational arrangements, including specifying the body before which the oath is taken and the party that recites the constitutional oath.

The third proposal suggests the possibility of the President deciding to call for early local elections.

The fourth proposal involves removing the requirement for the matching opinion of the Supreme Judicial Council regarding appointments to specific positions or the annual movement of heads of judicial councils and state commissioners, given that the President of the Republic is the head of the Supreme Judicial Council.

The fifth proposal suggests setting the term of the President of the Council of the Nation at six years instead of three, to maintain and link experience and continuity while avoiding the disruption caused by half-term changes.

The sixth proposal aims to improve the organizational framework for the ordinary parliamentary session, ensuring flexibility for its opening in September and its conclusion after 10 months.

The seventh proposal suggests reorganizing the composition of the Supreme Judicial Council by removing three categories: members chosen by the heads of parliament, union representation, and the head of the National Human Rights Council. In return, it proposes including the membership of the Attorney General of the Supreme Court.

Regarding the National Independent Authority for Elections, which the 2020 Constitution tasked with preparing, organizing, and managing the electoral process without specifying its oversight role, the eighth proposal suggests expanding its oversight duties and assigning the task of material and logistical preparation to the administration.

The ninth proposal for the technical amendment of the Constitution includes a transitional provision to be used when necessary to fill a constitutional vacuum and provide a basis for the partial renewal of elected members of the Council of the Nation during the first membership term after the third year, enshrining the principle of continuity of state institutions.

The tenth proposal suggests including a transitional provision aimed at determining deadlines for the compliance of institutions and bodies whose legal systems or compositions have undergone changes, by stipulating the necessity of this compliance within reasonable timeframes.
