Constitutional Court Continues Receiving Provincial Electoral Committee Reports

The Constitutional Court continues, within the framework of its powers, to receive the reports of provincial electoral committees concerning the legislative elections held last Thursday.

According to the Algerian Press Service, the reports are being submitted in line with the legal procedures in force. They are deposited at the registry of the Constitutional Court in exchange for an official receipt, as provided for in Articles 271, paragraph 2, and 275, paragraph 5, of Ordinance No. 21-01, which includes the organic law on the electoral system, as amended and supplemented.

The law states that the reports of provincial electoral committees, or those of electoral districts for citizens residing abroad, must be submitted no later than 96 hours after the close of voting. When necessary, the President of the National Independent Authority for Elections may extend this deadline by a maximum of 48 hours, in accordance with Article 271.

Immediately after the close of voting, municipal subcommittees began counting the ballots at polling stations and voting centers. The results were then recorded in official reports and transferred to the provincial committees.

Based on the vote-counting reports, the National Independent Authority for Elections announces the provisional results of the election of members of the People’s National Assembly. Under Article 209, paragraph 3, every candidate list, candidate, and political party taking part in the legislative elections has the right to challenge these provisional results by filing a petition with the Constitutional Court within 48 hours following their announcement.

In this context, the Constitutional Court notifies the list, female candidate, or male candidate whose victory is being challenged, allowing them to submit a written memorandum to the Court within 72 hours from the date the appeal is filed, in accordance with Article 209, paragraphs 3 and 4.

The Court rules on appeals after the expiry of this deadline and within three days, as stipulated in Article 210 of the law. The final results must then be announced within a maximum period of 10 days from the date the provisional results are received.

If necessary, this deadline may be extended by a decision of the President of the Constitutional Court, in accordance with Article 211 of the electoral law.
